What is Delta 8?
Delta 8 THC is a weak psychoactive cannabinoid found naturally in cannabis material, but usually only in trace amounts. Some people describe the effects of Delta-8 as “a cross between THC and CBD”, but this is not entirely accurate.

Does Delta 8 show up on a drug test?
Yes, Delta 8 can cause a false positive on a drug test, and there is no way to prove that it was Delta-8, not Delta-9, that caused the positive result. This is because drug tests look for metabolites of THC, not Delta-9-THC itself. Drug tests specifically look for the 11-hydroxy-THC metabolite. Like Delta-9, Delta-8 THC is converted to 11-hydroxy-THC in the body, causing the drug test to fail.
Is Delta 8 legal?
Because Delta-8 THC is derived from hemp, it is federally legal under the definitions used in the 2018 Farm Bill. By definition, legal hemp material includes:
“The plant Cannabis sativa L. and any part of that plant, including its seeds, and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, having a delta-9 tetrahydrocannabinol concentration of not more than 03 percent on a dry weight basis.”
Thus, products containing Delta-8-THC derived from cannabis and containing less than 0.3 percent Delta-9-THC are legal under federal law.

Of course, some states have conflicting laws, and Delta-8-THC is illegal in some states. State laws can change, but to date Delta-8-THC is illegal or restricted in the following states:
